        • OPENPLUS Energy Sistems makes this data protection document available for the purpose of describing all our practices as responsible for processing the personal data of our business partners, such as suppliers, customers, employees and other partners.

          The processing of personal data is collected and processed in strict compliance with the provisions of the personal data protection legislation in force at all times, namely Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016 (RGPD).

          1. Scope:
          This policy is applicable to:
          - OPENPLUS Business Partners (customers, suppliers, others)
          - OPENPLUS Collaborator

          2. Description of Personal Data and Source:
          - Personal data related to Business Partners (customers, suppliers, others)
          - Name
          - Business contact details (email, phone, mobile)
          - Communication content (email or business letters)
          - Payment and/or invoice information.
          - Other documents (eg: contract)
          - Personal data relating to an employee
          - Name
          - Contact details
          - Position/position
          - Communication content
          - Other documents (contract, invoices)

          3. Processing purposes, legal basis and consequences:
          - Perform the contractual relationship with the Business Partner (including fulfillment of contractual obligations, invoice processing, communication and legal and compliance activities).  Marketing activities (direct) and/or Security and fraud prevention.

          OPENPLUS is based on the following legal bases for such processing activities:
          - Execute the contractual relationship with the Business Partner;
          - Legitimate interest of Openplus, affiliates or other third parties (such as government agencies or courts). The legitimate interest may be in group-wide specific information sharing, (direct) marketing activities, fraud prevention or misuse of IT systems, physical security, IT and network security, internal investigations or potential merger activities and acquisition;
          - Compliance with legal obligations;
          - Consent, when the above legal bases do not apply.
          The provision of personal data is necessary for the conclusion and/or execution of the Business Partner's contract, and is voluntary. However, if you do not provide personal data, the affected Business Partner's management and administration processes may be delayed or impossible.

          4. Categories of recipients:
          Any access to your personal data is restricted to individuals who have a need to know it in order to fulfill their job and data processor responsibilities as identified below.
          As necessary, Openplus may share your Personal Data with Group companies, for internal administrative and marketing purposes.
          Openplus may hire service providers, acting as processors, to provide administrative and IT support (eg service providers who provide IT maintenance support). These service providers act as data processors.

          5. Limitation Period:
          Your personal data are stored by Openplus and/or our service providers for the period necessary to fulfill our obligations for which the data was collected.
          When Openplus no longer needs to use your personal data to fulfill contractual or legal obligations, it will remove them from systems and records and/or take steps to anonymize them properly so that you can no longer be identified, unless we need to. to keep your information, including personal data, in compliance with legal or regulatory obligations to which Openplus is subject, for example, statutory retention periods.

          6. Automation of Decision Making
          Openplus does not engage in automated decision making in the context of the relationship with its business partners.

          7. Your rights:
          (A) RIGHT TO INFORMATION AND ACCESS;
          (B) RIGHT TO AMENDMENT;
          (C) RIGHT TO DELETE ("RIGHT TO BE FORGOTTEN");
          (D) RIGHT TO LIMIT PROCESSING;
          (E) RIGHT TO DATA PORTABILITY;
          (F) RIGHT OF OPPOSITION;
          The data subject also has the right to file a complaint with the competent data protection supervisory authority.

          8. Information Security
          Openplus maintains adequate protection measures, including reasonable physical, organizational and technical security measures to protect its databases from unauthorized access, disclosure, alteration or destruction.

          9. Changes to Privacy Information
          Openplus reserves the right to change this privacy notice and will provide a revised privacy notice that reflects such changes as required by law.
